Samsung Agrees To Pay Apple $548 Million, But Claims Right To Reinbursement

In a nearly 5-year-old patent infringement dispute between Samsung and Apple, the South Korean electronics company has finally agreed to pay up – to the tone of $548 million, which is actually just a bit over half of the $1 billion that the court originally demanded.

But while Samsung has agreed to cough up over half a billion dollars, it made sure to note in its filing that it “reserves all rights to reclaim or obtain reimbursement of any judgment amounts paid by [the company] to any entity in the event the partial judgment is reversed, modified, vacated or set aside on appeal or otherwise.”

In response to Samsung’s comment, Engadget reports that Apple noted its rejection of the company’s claim to reimbursement rights.

The amount agreed upon by Samsung in the recent settlement — which, according to Reuters, would be paid on December 14 if the invoice was sent on December 4 — comes as a result of a United States court of appeals having reduced the settlement amount back in May.

The case is derived from Apple’s claim that Samsung copied not only the look of its iPhone, but also infringed upon its patents.

While Apple appears the victor of this particular battle, the war is by no means over as the two companies are headed back to court in spring when another trial kicks off over remaining damages pertaining to some of the S. Korean electronics company’s infringing products. And according to Foss Patents, a document they saw indicates that the two parties, Samsung and Apple, did not actually reach a settlement as a result of their discussions. Subsequently, this particular battle has yet to be concluded.
