A family injured in the fatal car crash involving Caitlyn Jenner is suing the Olympic gold medalist.

The Malibu family, the Wolf-Milesi family filed suit in Los Angeles Superior Court on Friday, according to court documents obtained by People Magazine.

The family is suing Jenner for negligence as a result of the February 7 crash which left one woman dead, as they allegedly sustained injuries in the deadly crash.

Jenner reportedly rear-ended Kim Howe, pushing her into oncoming traffic — resulting in her death. The SUV which plowed into her vehicle was being driven by Peter Wolf-Milesi, a music industry veteran who, along with three other members of his family and another passenger, sustained what the lawsuit alleges to have been serious injuries as a result of the crash.

According to the lawsuit, Peter’s wife sustained blunt-force injuries and subsequently requires ongoing treatment, his one-month old son was unresponsive immediately after the incident, and he himself sustained serious wrist injuries, NBC 10 reports.

In addition, the suit also alleges that the “emotional effects” of involvement in the deadly collision have induced “tremendous distress and suffering” for the family.

While investigators with the Los Angeles Sheriff’s Department determined that Jenner — who, at the time, had not yet made public her transgender status — was traveling at a speed unsafe for the road conditions at the time of the accident, prosecutors refrained from filing a charge of vehicular manslaughter against the 66-year-old celebrity television star.

In addition to the family’s lawsuit against Jenner, she’s also being sued by the driver of the other car that was involved in the accident as well as the stepchildren of the woman who tragically perished in the crash.
